FYI: Past, Present an Future of Death Penalty from Tennesse Law Review




For those who want more information on the history of the death penalty (to today and beyond), check out the post from the DPIC blog.  The Tennessee Law Review recently published a number or articles from its colloquium "The Past, Present and Future of the Death Penalty" (Feb 2009).  Visit the DPIC link for more info.

I hope to track down copies of the articles mentioned in the Tennessee Law Review that may be most relevant to Atkins cases.

FYI. Juveniles, SCOTUS, and Roper Reasoning PLUS Law review article dealing with executing mentally incompetent


Two FYI (with no comment) tidbits.

Related to ICDP recent post on APA's Amicus briefs re: adolescent cognitive maturity and capital punishment, the ACS Blog has a guest post re: whether SCOTUS should apply the Roper Reasoning to juveniles life-without-parole cases.


The CrimProf Blog featured a law review article (link to article is with post) by Markel on Panetti, Retributive Theory, and the Eighth Amendment.  As briefly outlined at CrimProf:
Markel dan Dan Markel (Florida State University College of Law) has published a thoughtful and nuanced article in the Northwestern University Law Review, Executing Retributivism: Panetti and the Future of Eighth Amendment. He argues that the version of retributivism that led to the Court's limits on executing the mentally incompetent have far more extensive implications.

FYI: Capital punishment info---staying current via e-newsletters and/or RSS feeds


If you are trying to stay current on issues, commentary, decisions, etc. regarding capital punishment in general (not necessarily just Atkin's MR cases), I suggest two general strategies.

First, on the right side of this ICDP blog I've provided links to a number of "Relevant Blogs and Web Pages."  Most of these blogs provide RSS feeds which "push" their regular blog posts to whatever RSS reader service you use.  You can then decide to visit and read a post based on the title and brief summaries that most RSS services provide.

If you don't want to deal with RSS feeds, a number of these sites provide regular e-newsletters that come directly to your email in-box.  You can skim the e-newsletters and decide whether to click and read more....or simply delete.  The three most informative e-newsletters I've found are from:
To subscribe you would need to go to each blog home page and locate the box, link, button, etc. that allows one to subscribe to content via email or an e-newsletter.

Whenever I find a post or story from any of the blogs I monitor that is relevant to the ICDP blog, I try to make a brief FYI post and provide a direct link for my readers.  So....I do post information from these sources that I think is relevant and interesting, but you are at the mercy of what I "filter in and/or out" as newsworthy.

Bit off-task FYI: ABA National Mentor Program for Lawyers and Law Students with Disabilities





This FYI post is a bit "off task" for the focus of the ICDP blog.  The post is intended primarily for folks in the legal professional who may be reading this blog.  I make this FYI post given my long-standing involvement in special education and disability issues during my career.

The Disability Discussion Docket (3D) listserv, a service of the ABA Commission on Mental and Physical Disability Law, just released its  National Mentor Program for Lawyers and Law Students with Disabilities handbook.

As mentioned in the list post, "The Handbook is an easy to use document that has tips, definitions, and concepts to make your existing mentor-mentee relationship even better! The Handbook is meant for mentees and mentors, novices and experts."
