FYI: Atkins related news stories and updates

Some recent Atkins related news stories and updates.  Thanks to Kevin Foley for the info.
 
David Johnson (Fla) –title of report indicates the legislature stayed Johnson’s execution, while the body of the articles says it was the Fla Supreme Court. Obviously, it was the court, since they just heard argument the other day.

Rasheem Dubose – Jacksonville Fla.  Criminologist James Fox testified about Dubose’s IQ.  Is this testimony beyond the person's area of expertise?

Supreme Court refuses to hear (and thus will not overturn) lower court’s finding that Eric Lynn Moore was MR/ID. The 5th Circuit opinion is posted in the Court Decisions section of the ICDP blog. A prior guest post by Kevin Foley (The Courts Dropped the Ball) can be found here.

South Carolina- State will not appeal trial court finding that Edward Lee Elmore was MR/ID.

Abstract  
We adapt the victimology of 'state harms' framework outlined by Kauzlarich et al. (Critical Criminology10(3), 173–194, 2001) to understand the post-exoneration experiences of 18 death row exonerees. Kauzlarich et al. develop six points of commonality shared by most victims of state crime. Application of this framework to death row exonerees highlights the role the state plays in creating and exacerbating the harms they suffer. This analysis also lays a foundation for further theoretical inquiry into the wrongful conviction of the innocent as a form of state crime.

Book note: Hispanic neuropsychological assessment: Dr. Marcel Ponton

I had the opportunity to chat (via phone) with Dr. Marcel Ponton today re: the BAT III and interpretation of test scores in the context of Atkins MR/ID cases.  I found the discussion stimulating and at a very professional level re: intellectual assessment of individuals with Hispanic backgrounds.  Although I have not read his book, nor do I have a copy, my positive impressions were such that I would like readers of the IDCP blog to be aware of his book.  His book "The Hispanic Patient and the Neuropsychological Asessment" might be worth a look by examiners engaged in psychological assessment of individuals with Hispanic backgrounds.

What is an iPost?

Readers of my various blogs may have noticed my labeling of short
posts as "iPosts". This indicates that I have made the post to my
blog directly from my iPhone. Although the posts are typically FYI
posts that provide links to other blogs, it is actually quicker to do
on my iPhone when compared to doing it on my computer. It is my
attempt to "pass a long" info I find in numerouse blogs I monitor
directly from my iPhone via Mobile Bloglines
Starting today I plan to add the above graphic to these posts. They
always have the messy original URLs and not tiny URLs.. But that is a
sacrifice made for quick spread of info. If in a real hurry I may
forget the icon.

IQ Test DNA Fingerprints: Comparison of WJ III/BAT III, WISC-IV and WAIS-IV

Here is another in the series of IQ's Corner "IQ Test CHC DNA Fingerprint" test comparison series.  This particular CHC fingerprint figure compares the CHC composition of the respective full scale total composite IQ scores from the WJ III/BAT III and the WISC-IV and WAIS-IV.
